The Hays County Courts at Law hold jail docket every Thursday at 1:30PM via Zoom. Inmates are no longer transported to the Government Center unless a request is made and approved by a Judge. Any attorney who needs an in-person hearing, please contact the Court to arrange transportation of your client.

Hearings for civil, probate and guardianship cases:

All court proceedings have returned to in-person settings as of June 1, 2021. Uncontested probates are permissible via Zoom with the exception of pro se probates. Pro se probate cases are required to appear in person. See the section below titled "Hays County Courts at Law Probate Policy Regarding Pro Se Applicants" for additional information.

All documents, including proposed orders, shall be e-filed prior to the hearing.

Hays County Courts at Law Probate Policy Regarding Pro Se Applicants (Applicants without an Attorney)

Under Texas law, individuals applying for letters testamentary, letters of administration, determination of heirship, and guardianships of the person or the estate must be represented by an attorney. This legal requirement follows from the law that only a licensed attorney may represent the interests of third parties or entities. The only time a pro se applicant can proceed in court is when the applicant is truly representing himself or herself.

Therefore, the Hays County Courts at Law require individuals making and pursuing these applications to be represented by an attorney. See the FAQs regarding the Hays County Courts at Law Probate Pro se Policy for more information:

For the public, The Open Courts Provision of Texas law allows all Texans access to court proceedings. The judge, bailiff and court reporter will conduct the hearings in open court, open to the public. In addition, Zoom allows a judge to easily stream the proceedings to the public via YouTube or Facebook. The public may view or listen to the proceedings, but VIDEO OR AUDIO RECORDING IS PROHIBITED. All courtroom rules and safety measures MUST be followed by Order of the Court.
